The unfair dismissal threshold for managers – what’s included and what’s not

Employees who are not covered by an award or to whom an enterprise agreement does not apply, and whose annual rate of earnings are equal to or more than the high-income threshold cannot bring an unfair dismissal claim. In calculating annual rate of earnings, it is therefore critical to understand both the amounts that are included in calculating the threshold, and those that are not. This information cites the cases that determined the relevant matters.
